Living in Bulgaria: administrative and tax residency

Administrative residency and tax residency operate according to distinct principles. Obtaining your residency card is essential for legally settling in Bulgaria as an expatriate, but it is not sufficient to transfer your tax status to Bulgaria.

Here is a clear distinction between these two statuses, followed by the strict conditions required by Bulgarian law to formalize your change in tax status.

1. Administrative Residency vs. Tax Residency

Tax residents are taxed on their worldwide income, while non-residents are taxed only on their Bulgarian income. The following table summarizes the major differences between the two statuses:

2. Conditions for becoming a tax resident in Bulgaria

Article 4 of the Bulgarian Law on Personal Income Tax defines four alternative criteria. Meeting just one of these conditions (subject to double taxation treaties) qualifies you as a Bulgarian tax resident:

183-Day Rule (Physical Presence)

  • The condition: Remaining in Bulgaria for more than 183 days within a rolling or calendar period of 12 months.
  • Calculation: Days of entry into and exit from the country count as full days of presence.
  • Exception : Stays undertaken solely for educational or medical treatment purposes are not counted.

Center of Vital Interests

  • The condition: Demonstrating that your closest personal and economic ties are in Bulgaria.
  • Economic evidence: Location of your main business, active bank accounts, real estate investments, or local employment contracts.
  • Personal evidence: Presence of your spouse and children in Bulgaria (schooling, community involvement).
  • Note: This criterion may take precedence over physical presence, particularly for entrepreneurs and digital nomads.

The combined permanent address

  • The condition: Having a registered permanent address in Bulgaria, provided that your center of vital interests is not located in another country.
  • Having a permanent address in Bulgaria while your family and business remain in France is not sufficient.

3. The trap of international tax treaties

Obtaining Bulgarian tax residency does not automatically sever your ties with your country of origin. If the French or Belgian tax authorities believe that you also meet their national criteria (for example, if your family still resides there), a conflict of residence arises.

To resolve this, the authorities use the tie-breaking rules of the Double Taxation Convention (OECD Model) in the following order:

  1. Where do you have a permanent home?
  2. Where is the center of your vital interests (closest family and economic ties)?
  3. Where do you usually reside?
  4. What is your nationality?

To officially validate your 10% tax rate, you will need to request a Tax Residence Certificate from the Bulgarian NRA and present it to the tax authorities of your country of departure to formalize your departure.
